PRIVACY POLICY

WHAT DOES THIS DOCUMENT INCLUDE?

For the optimal functioning of this app, it is necessary to collect and process certain information obtained from the device on which it has been installed. This information allows us to improve the app, adapt the content optimally for each user or contact the user if necessary. To show that we care about the privacy of our users, we have adopted this Privacy Policy, which explains, in understandable and easy-to-understand language, how we collect, store, use and disclose the information that users entrust to us.

1. WHAT INFORMATION DOES THE APP COLLECT?

This application collects the necessary information for the normal functioning of our activity. This App does NOT collect personal information for malicious purposes.

The app does NOT secretly collect information such as your name, surnames, telephone number, email, etc.

Data such as: username, email or location, is requested from the user explicitly and with his consent, only in the event that he wishes to send us links to videos to be shown in this app.

In the app it will only show the name that the user prefers.

2. WHAT INFORMATION DOES THIS PRIVACY POLICY COLLECT?

The App can collect information of two types: (1) non-personal and anonymous information collected automatically or (2) personally identifiable information (PII) collected manually after the user’s consent.

Non-personal information collected automatically

Technical information, which includes certain information or characteristics about the operating system, including the type of operator or the type of browser you use, the Internet Protocol (IP), the IP address and the names and versions of the applications installed on the device, the geographical location of the device (including GPS coordinates). Said technical information such as the one mentioned above remains anonymous, that is, it does not identify it personally nor is it associated with any other information that links it to the user, unless the user voluntarily enters additional information.

This information will be used to improve the application, learning how, when and where the user navigates through it.

Information that the user freely provides

If at any time the app requests Personal Identification Information (PII) that allows us to contact it, such as name or mobile phone, the user will be free to offer said information. Nevertheless:

• If you share your PII in an open format (for example, through social networks), the information we obtain will not be protected by this privacy policy.
•   • The PII will not include any type of information collected by the application by any means other than this application in which the privacy policy appears. This means that information collected anywhere other than this application is not covered by this Privacy Policy. It should be noted that, if in any case the app offers links to other applications, we are not responsible for the content, activity or information that takes place in them.
• Information of a personal nature is considered:

•   • Demographic information such as age or date of birth, nationality, educational level, gender, interests or qualities.
•   • User Information such as username and password, confidential answers to certain security questions, or similar information that allows us to uniquely identify or authenticate your account before providing personal information about the user’s account.

Most of this data can be obtained when the app offers a social registration functionality and the user accepts the registration in the app through a social account. In some cases, the app automatically registers with the user’s social account associated with the device and the user agrees to extend such registration by using this app.

3. WHAT HAPPENS TO THE INFORMATION WE COLLECT FROM CHILDREN?

This app does not collect personal information from children under the age of 13. We take children’s privacy seriously, and we encourage parents to play an active role in their children’s online education at all times. Children under the age of 13 must not install our application on any device that belongs to them and, if they do, it will be at the full risk of their parents or guardians. If we obtain personal information from a child under the age of 13, we will take steps to remove the information provided from our server. In the event that the content of this application has received a rating of suitable for children under 13 years of age, it should be installed exclusively on devices owned by your parents, guardians or anyone over 13 years of age. If the application requests Personal Information at any time, children under 13 years of age should never enter such information.

4. HOW DO WE COLLECT PERSONAL INFORMATION?

In addition to the established information, we use cookies to collect user information when you visit our application. Cookies are information that a web page or application sends to the device when you are browsing said application. For example, when you decide to return to our application after registering, cookies provide us with information so that our server remembers who you are. You have the possibility to accept or reject cookies, depending on the configuration of your device through the configuration options. If you refuse to receive or delete cookies, access to some services may not work properly.

5. HOW DO WE USE THE INFORMATION YOU PROVIDE US?

We use the information we collect from you in the app as follows:

•  • Personalize and improve your experience and allow us to provide you with the type of content and offers that best suit your interests.
•  • Deliver, provide and repair products or services.
•  • Send you communications such as welcome letters, purchase confirmations, payment notices or administrative provisions.
•  • Establish and maintain user accounts and their history.
•  • Contact you about our products and services and send you the best offers and promotions based on your interests.
•  • Study the statistics of our online platform.
•  • Inform our customer service employees.
•  • Establish your online account and authenticate it during your user registration.
•  • Quickly process your requests for information.
•  • Allow us to respond efficiently to your questions.
•  • Analyze a promotion or a survey.
•  • Send you promotional material.
•  • Allow us to share the information with third parties in the terms that have been described in these privacy policies and for the purposes described in the previous points, whenever it is permitted by law.

6. WITH WHOM DO WE SHARE THE INFORMATION?

This application may monetize your information, transferring it to third companies (in some cases), your PII and user information, in the following situations:

• • When the app is monetized through advertising, the advertising networks and/or the advertisers that serve the ads may require certain information from the user or from the device in order to serve the most appropriate or interesting ad for the user. The app can use networks such as Mobincube, Startapp, Airpush, Tappx, Facebook, Amazon, Google or Docomo, among others.
• • When we contract with third-party advertising networks to display our app’s banner ads when you visit third-party websites. To do this more efficiently, the advertising network may use and insert certain technologies, such as cookies, into your device to collect non-personal information from you when you visit our application. This information is used to display advertisements about goods and services that are more relevant to your interests when you visit other web pages.

We often assess (sometimes with the help of outside companies) how our online content and services are performing. The information released for this purpose will rest on the company’s server and will be limited to its professional use. In no case will the PII or the user’s information be shared except as established above.

When data disclosure is required by law or is intended to protect the security of applications, this application has the right to disclose any information collected, regardless of when that information was collected. We will only make this disclosure when permitted or required by law, or when we believe there are good faith reasons: (I) to protect your safety, including your property, (ii) to protect the safety of your applications or third parties and (iii) to execute the terms of use, updates or promotions.

7. WILL THERE BE THIRD PARTIES THAT COLLECT INFORMATION FROM YOUR APPLICATIONS?

There are certain situations where a third party may collect information from the application. This app uses third-party libraries that offer certain functionality: analysis tools, communication tools, social networks, advertisers, etc.

•  • Analysis tools: To improve the application, we sometimes use tools that analyze user behavior. This way we can know which parts of the application are most important and which ones need improvement.
•  • Communication tools: if at any time we need to communicate with users, we integrate third-party tools that facilitate this communication, either through push notifications, emails, alerts within the app, etc.
•  • Social networks: if your app ever connects to a social network, it will ask you for authorization. Once the connection is authorized, the social network will be able to access certain information.
•  • Ad networks: In the event that this app shows advertising, it usually comes from ad networks that connect with advertisers. These networks need certain information in order to provide the most suitable advertisement for you.

This application reserves the right to give certain user information to companies that collaborate with us or to software developers that provide some functionality of the app. We provide this type of access to such companies in order to generate interest in our products among members with whom we have some type of agreement as well as to allow you and your friends to reach you and your friends the type of product we offer. The information collected by us will be treated in accordance with the terms of this Privacy Policy, but the use of the information by a third party will be treated according to their own standards. This application does not guarantee that the other party complies with your security policy.

8. WHAT TYPE OF SECURITY MEASURES DO WE TAKE TO SAFEGUARD YOUR PERSONAL INFORMATION?

The security and confidentiality of your information is extremely important to us. For that reason we have technical, administrative and physical security measures in place to protect your personal information from unauthorized access and fraudulent use. We also review our security system periodically to insert technological innovations and update methods. However, despite our best efforts, no security method is completely perfect and foolproof.

You, too, can play an important role in keeping your information safe. If you are required to create a unique password to restrict access to your account, choose a password that is difficult for other users to guess, and be careful not to reveal it to anyone. It is your responsibility to keep your password and account information safe at all times. If you use a public or shared mobile device, never save user and always log out of your account whenever you stop using the device.

Finally, with respect to companies that have an agreement with this application, we require them to agree to protect our terms of confidentiality, integrity and security of any personal information that we share with them. When your personal information is shared or simultaneously collected by a third party as set out above, it will either be obvious to you from the context (such as the appearance of a third party on the phone screen) or you will be notified at the time in which personal information is claimed. In addition, you will be given the opportunity to accept or decline these types of practices before they begin. As stated in section 3 of this Privacy Policy, we do not collect personal information from children under 13 years of age and we inform them that they should not use our tool in any case. In this way, this application will not share information collected from children under 13 years of age with any type of company that has signed a collaboration agreement.

In the event that we detect that any of our technological partners put your integrity at risk or used your information to carry out any illegal action, we will take the appropriate measures to cut off the relationship with said provider.

10. HOW WILL YOU KNOW IF WE CHANGE OUR PRIVACY POLICY?

This application reserves the right to modify this privacy policy at any time, although it is not customary. Any changes to the policies will usually be accompanied by an update to the application version. At the beginning of these policies you can find the version number and the date they were edited. In the event of a material change in how we collect, use, or share personal information, we will add those changes to a new version of these policies.

11. CLARIFICATIONS REGARDING THE USE OF THE ANDROID ADVERTISING ID

Version 4.0 of Google Play services has introduced new APIs and an identifier code (ID) that can be used by analytics and advertising providers. The following are the terms of use of these APIs and this ID.

Usage. The Android Advertising Identifier is only used for advertising and user analytics purposes. The status of the option to opt out of interest-based advertising must be verified on each access of the ID.

Association with personally identifiable information or other identifiers. The advertising identifier is not linked to personally identifiable information or associated with any persistent device identifier (for example, SSAID, MAC address, or IMEI) without the user’s explicit consent.

Respect for user selections. Upon reset, the new advertising identifier is not linked to a previous advertising identifier or to data derived from a previous advertising identifier without the user’s explicit consent. Likewise, the option to disable advertising based on user interests is offered. If a user has enabled this option, the advertising identifier is not used to create user profiles for advertising purposes or to reach users with interest-based advertising. Permitted activities include contextual advertising, frequency capping, conversion tracking, reporting, and fraud and security detection.

Compliance with the conditions of use. The Advertising Identifier is only used in accordance with these terms, including for use by any party with whom you may share it in the course of business. As of August 1, 2014, all updates and new apps uploaded to the Play Store must use the Advertising ID (when available on a device) instead of any other device identifier for advertising purposes.

12. CLARIFICATIONS REGARDING ACCESS TO YOUR TELEPHONE NUMBER

This app has not been developed to obtain the phone number of your phone and no functionality has been added to it to obtain it. The app has been created on the Mobincube development engine, which does not include any line of code that allows access to the phone number.

The app includes some third-party libraries (SDK), used in the case of monetization with advertising. We do not have access to the source code for these third party SDKs, some of which access and collect the phone number. In the event that we detect any of these advertising networks engaging in such practices, we will remove them immediately and publish a new version of the application, to protect your privacy.
